The subject closest to the heart of most adjudicators, i.e. payment of their fees, has not featured for a while so it seems to me time to put that right, particularly considering my recent experience in a challenging case.

A fundamental problem when representing a party is that you do not know how the Adjudicator will apply the rules of evidence. When acting myself as an Adjudicator I have always developed a Scott Schedule tracking the points relied on by each party in the various submissions, and importantly recording which points have been denied. If they have not been denied, when drafting the Decision I assume the point is admitted: but is this approach correct?
