As everyone is by now aware, a contract must comply with the "eight pillars of adjudication" failing which the Scheme for Construction Contracts ("the Scheme")applies. In England and Wales the Scheme for Construction Contracts (England & Wales) Regulations 1998 applies and in Scotland, the relevant Scheme is the Scheme for Construction Contracts (Scotland) Regulations 1998. The Schemes set out procedure and flesh out the jurisdiction, powers and duties of the participants in adjudications to which they apply.
