Challenges to an Adjudicator's jurisdiction have been par for the course since the introduction of Adjudication. Some Respondents make challenges systematically in case they can find an argument to resist enforcement. The Courts, however, remain reluctant to uphold such challenges. The reason being that in Adjudications, "The need to have the 'right' answer has been subordinated to the need to have an answer quickly" (Carillion Construction Ltd v Devonport Royal Dockyard Ltd [2005] EWCA Civ 1358).
